1. Parties and purchase
Sightkeep is developed and supplied by Xinogi. Sightkeep consists of two macOS applications, LiveFramePin and Tsumami UI, licensed together as one product. Polar acts as merchant of record and authorized reseller for purchases. The Polar Buyer Terms also apply.
2. License
After full payment, you receive a limited, personal, non-exclusive, non-transferable license to install and use the purchased versions of both included applications on up to two Macs that you control, unless a different allowance is stated at checkout. A single license key activates both applications, and having two applications does not reduce the two-Mac allowance. The license is a one-time purchase and is not a subscription.
You may move the license to a replacement Mac by deactivating an old installation where available. You may not resell, sublicense, share, rent, or distribute the applications or license key.
3. Responsible use
You are responsible for the content you capture, display, save, stream, or record and for obtaining any required permissions. You must not use the app to violate law, privacy, intellectual-property rights, service terms, or technical access restrictions.
You may not reverse engineer, bypass licensing or security controls, or modify or redistribute the app except where applicable law expressly permits such activity.
4. Operating limitations
DRM-protected or restricted content may appear black or fail to capture because of macOS or content-provider restrictions. LiveFramePin does not bypass those protections.
Source Pins depend on macOS making the target window available for capture. Minimized, hidden, Stage Manager-hidden, full-screen, protected, or otherwise unavailable windows may pause or fail to update.
Tsumami UI handles appear only on the desktop (Space) where they were attached, and full-screen windows are outside its scope.
5. System requirements and permissions
Requirements differ per application. LiveFramePin requires an Apple silicon Mac (M1 or later) running a version of macOS 14 Sonoma or newer that we identify as supported; Screen Recording permission is required for its core capture features, and optional voice input requires microphone and speech-recognition permission. Tsumami UI runs on Universal 2 (arm64 and x86_64) with macOS 12.0 or newer and requires Accessibility permission; it does not use Screen Recording. Compatibility may vary with macOS, hardware, other applications, and third-party content.
6. Ownership and updates
Xinogi and its licensors retain all rights in the applications, branding, and related materials except for the limited license granted above. The one-time license lets you continue using the purchased versions on compatible systems. Maintenance, security, and compatibility fixes that we provide for those versions do not require another license purchase. Future major feature upgrades or higher product tiers may be sold separately. The license does not promise indefinite support or compatibility with future macOS releases or hardware, and a future macOS release may require an app update.
7. Availability and warranties
The app is provided on an “as available” basis. To the extent permitted by law, we do not guarantee uninterrupted operation, compatibility with every app or content source, or error-free results. Nothing in these terms excludes warranties or remedies that cannot legally be excluded.
8. Limitation of liability
To the extent permitted by law, Xinogi is not liable for indirect, incidental, special, or consequential loss, loss of data, lost profits, or third-party claims arising from use of the applications. Where liability cannot be excluded, Xinogi's aggregate liability relating to the purchase is limited to the amount you paid for the product. These limits do not apply where prohibited by law or to liability that cannot legally be limited.
9. Refunds and termination
Refund requests are handled under our Refund Policy and the applicable Polar terms. A refunded, charged-back, shared, fraudulently obtained, or materially misused license may be disabled. Sections that by nature should continue after termination remain effective.
10. Privacy
Our handling of personal and technical information is described in the Privacy Policy.
11. Governing law
These terms are governed by the laws of Japan, without regard to conflict-of-law principles. Courts in Japan have jurisdiction, unless mandatory consumer law gives you the right to bring a claim elsewhere. Nothing in these terms limits mandatory consumer protections that apply in your country or region.
12. Changes and contact
We may update these terms for future purchases or service changes. The version in effect when you purchase governs that purchase unless a change is required by law or accepted by you.
